Two Jacksonville police officers who fatally shot a fleeing armed felon in Springfield last year acted properly in using deadly force after he repeatedly threatened them and the public, a police response to resistance board found this morning.

Kiko Battle, 24, died after being shot repeatedly on June 15 by Officers John Nobles and Timothy Terrell shortly after they stopped Battle and another man walking in the middle of the 100 block of West 18th Street in Springfield.

The shooting occurred in an area where several of Battle’s relatives live, including some who insisted that the gun was not Battle’s and that he didn’t pose a threat. But the review board, using testimony from both officers and statements from other witnesses who included the man walking with Battle, concluded the gun belonged to him and that he was a danger to those around him.

A State Attorney's Office review of the shooting found it was justified. The review board found that the officers didn't violate any departmental policies or procedures and don't face discipline or retraining.

The officers, working off-duty and in uniform for the Springfield Preservation and Revitalization Council, said they simply intended to write Battle and his friend a pedestrian citation for walking in the street.

The friend, Avery Middleton, cooperated with Terrell and was put in the officer’s car. Battle, however, appeared to be hiding something, argued with Nobles and then pulled away, Nobles said. Nobles fired his Taser at Battle and a gun dropped from Battle's waistband as he collapsed.

Battle picked up the weapon as he was rising and began pointing it toward the officers, they said. Nobles fired several shots. Battle was hit and began to run as both officers ran after him. He climbed over a fence still holding the gun and was ordered to stop. He was shot again moments later by the officers. His loaded gun was found by his feet.

Assistant Chief D.R. Daniels, one of five police officials who make up the review board, said Battle didn’t take advantage of several opportunities to avoid being shot, including when the gun first dropped from his waistband.

“To re-arm yourself with two police officers is not a prudent thing to do,” Daniels said.

About a half-dozen of Battle’s family attended the hearing and several said they were not satisfied with the outcome.

“They’re not telling the truth,” said Battle’s grandmother, Ruth Sanders, 71.

The board also ruled this morning that an officer acted properly when he fatally shot a man last year as the man was dragging another officer in a moving car .

Officer T.M. Burnley fatally shot Robert Louis Johnson, 44, in September after a traffic stop in which Johnson dragged Officer C.M. Jones as Jones hung onto Johnson's steering wheel. The incident occurred on East Fourth Street. Jones tried to use his Taser as Johnson drove off, but it didn't stop the man. He then hollered for Burnley to shoot and the officer fired three times. The car came to a stop moments later.

Officer Nobles is a hell of a good guy, and a good police officer. Im sorry for the families loss, but Im also glad that we will still have Officer Nobles on the streets, hopefully in Springfield.

From my understanding, The off duty officers patroled areas just outside our borders as well.

That said, the issue is moot, as I believe the crime fund is no longer active.

I had coffee with Officer Nobles a few months ago, where he recounted some crazy stories of Springfield back when it was the Wild West.

Good to see he's been formally cleared.

How many witnesses stated that and how many differed?

The point of contension is not about wether or not he armed himself will resisting the officers, but only wether or not he pointed the gun?

Is there an alternative rationale for why he is arming himself while aggressively resisting that does not make him a clear and present danger?

Since you changed the course of your rhethoric in response to my very sensible question, I have to assume you have no other ration explanation to why he would arm himself other than to make himself dangerous.

I find it funny that you are so admenant about restricting access to guns, except in this case where Mr. Battles is arming himself...

Unless you have an answer for this question, any reasonible person would believe the officer is about to be shot by Mr. Battles...

Beyond that, unless you keep dodging the question, I think we're done here.  Once again its shown that anyone on MetroJ can make any inane statement they want, then spend all their brainpower on escaping responsiblity for the statement with slight-of-hand posts.. horay for the internet...
