Great piece of investigative reporting by A.G. Gancarski at Florida Politics.  Her financial shenanigans and husbands claims of chocking her daughter, where she actually lives and the location of her primary residence perhaps "Davie Florida" not Jacksonville and so much more including her apparent disregard of the laws concerning corporate distributions and expenditures.  That cult business she runs sure is profitable!

Dear Councilman Gulliford,



An article written by A.G. Gancarski indicates there is possible evidence that Kimberly Daniels is not properly qualified to serve as a member of the Jacksonville City Council (Kim Daniels' divorce filing yields questionable financial details;  http://floridapolitics.com/archives/19836).



According to divorce documents filed with the court, there are deed transfers to and from Ms. Daniels (and her husband) and a corporate entity that she owns related to a "marital home" in Davie, Florida.  Further, there are no properties in Jacksonville, Florida owned by Ms. Daniels (or her husband).



Charter Section 5.07 indicates that the City Council shall judge the elections and qualifications of councilmen.  It is therefore that I ask that you, as Rules Committee Chair, to order an investigation as to whether Ms. Daniels is qualified to serve in the At Large Group 1 seat that she currently holds and for which she is seeking re-election.

It's certainly worth looking into, but you don't have to own property in Duval (or anywhere at all) to sit on the Council. You just have to have residency there. It seems pretty clear she couldn't have residency in the Davie house if she's been locked out of it for months. The potential financial irregularity, though, is definitely worth looking into.

The FBI is investigating whether or not Kimberly Daniels has legal standing to hold political office in Jacksonville?

I don't know the particulars of the FBI complaint.  That was not initiated by me.  Below is the response I got today to the email sent to Bill Guilliford.

Response:
I discussed this issue with the General Counsel and he supported the action I took at Rules Committee on Monday. At the end of the meeting I provided each member a copy of all correspondence and emails as well as your article. I indicated that should any member wish to initiate an investigation that opportunity was available to them. The Charter is very vague and the Rules Committee is not specifically tasked with such an action but it does seem logical that they would start it. Before any investigation the appropriate course would be an affirmative vote by the committee to proceed with such an investigation,

but normally the Chair does not offer motions. We will see how it evolves but I don't think there is any appetite to pursue it prior to the election for fear it might be view as political action by the committee or individual council members. Furthermore, the outcome of the election could make the issue irrelevant.

Lastly, the timing is such that procedurally,  I don't believe ay action taken by the full council would see fruition before the May 19th election.



Should you discover more evidence that supports a position that she is not qualified I would appreciate your forwarding it to me and I will send it on to my committee members. Rules will meet again in two weeks.
