This is excellent news. However one news report says:

I'm surprised he's still alive after an hour of gunfire.

JEB Stuart would probably disagree with you there. Shot dead by humble private and Michigander hero John A. Huff, who was across the field and falling back, with a single shot... from his revolver.

As of three hours ago, the second suspect Dzhokar Tsarnaev remains in serious condition.  He had lost a lot of blood and doctors say he would likely have died if not captured when he was.  There is also a photo of his brother from the morgue that was leaked.

Boston.com reported that at 1:20 a.m., an “unconscious, handcuffed, and in cardiac arrest” Tamerlan Tsarnaev was wheeled into Beth Israel Deaconess Medical Center, where emergency crews performed CPR. A tube was placed into his throat and chest. However, emergency officials said he could not be saved due to a massive loss of blood.

Tsarnaev was declared dead at 1:35 a.m

The latest is that Dzhokhar Tsarnaev will be prosecuted in civilian court as an American citizen.  This is the way this should be handled in my opinion. 

Quote(CNN) -- The federal government filed two charges against Boston Marathon bombing suspect Dzhokhar Tsarnaev Monday, counts that could result in the death penalty if he's convicted.

Tsarnaev, 19, was charged with one count of using and conspiring to use a weapon of mass destruction resulting in death and one count of malicious destruction of property by means of an explosive device resulting in death, according to a statement from the Justice Department.

Tsarnaev made his initial appearance Monday before Magistrate Judge Marianne B. Bowler in his hospital room at Beth Israel Deaconess Hospital in Boston. A public defender was appointed to represent him, according to the office of the Federal Public Defender in Boston.

A probable cause hearing has been scheduled for May 30 in U.S. District Court.

The decision to charge Tsarnaev in civilian court put an end to speculation that he would be charged as an enemy combatant, a designation sometimes used against terrorists.

I don't either fsquid.  Like it or not he was an American citizen.  I am sure the prosecution will push this case hard.  The only difference is that Massachusetts does not have the "death penalty" where the federal level does in cases like this, but he was not legally an enemy combatant.

You can clearly hear .223 and pistol shots in that video.  The pistol shots sound like sticks breaking and the .223 rounds have a bigger sound both from the size of the load and the supersonic crack of the bullets.   You can hear the echos of the .223 rounds from the surrounding buildings.

Hope there weren't any people beyond that boat in the line of fire.  Guess we would have heard about it by now if there were.

Why were they shooting so much if they were working so hard to try to take him alive for questioning?

My guess is built up tension.  I suspect we will hear later how many shots actually hit the boat.  That will tell us in more detail where the shots fired actually went.  Some of that firing was tear gas wasn't it?  I do know that police shagged of some CNN media that was standing in the lot behind the boat.  Not too bright.

Watched a couple of interesting reports on this unfolding story and learned a some things that I didn't know before about what took place preceding the capture of the younger brother and bombing suspect.  The Police Chief from Watertown Massachusetts said in an interview last night that the older brother died as a result of being run over by the younger brother when he made his escape.  The Chief described the final moments of the first shootout with the two brothers saying that once they had been stopped, both came out of the hijacked vehicle shooting.  The older brother kept walking towards police and shooting until just a few short feet from an officer he ran out of bullets.  It was at that moment that two officers jumped on him and took him to the ground.  As that was happening the younger brother jumped into the stolen vehicle, slammed it into reverse and gunned it.  The officers jumped out of his path at which time he ran over his older brother dragging him for several feet.  According to the Chief, the brother was not fatally injured by the gunfire, but was killed by the car.  In this one instant it would appear to my mind at least that his own actions and indoctrination of his brother into hatred ended his own sorry life.  There is some justice in that.

It was also very chilling to see that the older suspect was married to an American woman and had a small child.  His wife, now widow is clearly devastated by all that has happened and in shock.  It appears it was she who worked up to 70 hours a week to feed the family, while he stayed home with the little girl.  I still cannot fathom the mind of a person with his own small child at home, readily killing the child of another not to mention the lovely young ladies whose lives he and his brother ended.  There of course remain all the others who are scarred for life physically and emotionally, which now include his own wife and child.  Their lives will never be the same again either.  Sad stuff.
