A Jacksonville City Council panel agreed Thursday to back a stopgap measure waiving enforcement of the city’s noise ordinance during this month’s Welcome to Rockville show at Metropolitan Park.

An ad hoc committee reviewing a range of issues agreed to introduce legislation at Tuesday’s council meeting setting aside civil and criminal penalties for noise violations before April 30 and allotting $2,500 to measure sound levels in St. Nicholas and the Eastside during the April 27-28 concert.

The money would come from a Metro Park trust fund that committee members were told has $753,000 now. St. Nicholas residents have complained about excessive noise from shows at the park, but haven't been able to get reliable measurements.

Sound readings in neighborhoods north and south of the riverfront park, as well as measurements at the control panel used during the concert, will help the committee decide reasonable standards that can be used in the future, said Councilwoman Denise Lee, who chairs the panel.

Concert promoters Danny Wimmer and Danny Hayes told the committee they had thought they would be operating within the law because a city ordinance seems to exempt ticketed shows at Metro Park from the noise ordinance.

But lawyers have since said the exemption may only apply within a city-designated “entertainment zone” that doesn’t include the St. Nicholas area. That made the promoters worried about whether the two-day show could be interrupted midstream.

“What causes me to lose sleep is this fear … on Sunday [the second day of the show] the sheriff is there and says ‘sorry, fellas, no show today,’ and we have 10,000 paid patrons [waiting],” Hayes said.

St. Nicholas resident Ginny Myrick, a former councilwoman, called the measure “a good compromise.” She told the committee she wants show promoters to be able to stay in business â€" just a little quieter.

The issue of Metro Park and the ongoing allowance of the city to grant complete and total noise exemption to the leased events is again on the agenda. Many of you share the concerns over the noise decibels.....Many of you take exception over the vulgarity of spending the weekend hearing the foul language clearly which would be mitigated with decibel control, event management, and the ability to register complaints...Many of you take exception to how the park and its usage has evolved without proper attention by the city.

You don't have to speak, but if you have any passion about this topic please consider showing up. If you show up WE WILL GET THEIR ATTENTION.......Our neighbors in St. Nicholas have purchased TSHIRTs and have asked for 100 people to show up. Beth & Jan: I have been attending and speaking at most of the Metropolitan Park Ad Hoc Committee meetings along with 2 Southshores neighbors, Jeanine Balanky and Katherine Moore. I have been making my comments representing just myself. The Ad Hoc Committee has done a deep dive on history, funding and management of Met Park and should be releasing their report back to City Council soon. A big focus has been on the decibel level and time of events being held in the park for the allowable 12 "ticketed events". The promoter for the event April 27 & 28 (Rockville) has been in attendance at the meetings also. The promoters, although participating in the Ad Hoc meetings, also made a direct appeal to Councilwoman Kimberly Daniels to protect their event production by introducing a bill which would exempt Met Park from the sound ordinance. It was assigned to 2-committees. It failed in the Committee she Chairs and was deferred with the understanding the Ad Hoc Committee will immediately make recommendations for sound decibel levels so their show would not be closed down during production because of complaints. CM Daniels' bill passed out affirmatively from the second committee it was assigned to; technically making it possible to be on the floor Tuesday night for full Council Action. The bill number is 2013-166. Their argument is framed as an economic development issue, bringing lots of people to Jacksonville for their concerts.

When the Ad Hoc Committee met yesterday they took up the challenge to set the dB level at concerts, but were unable to come to consensus because there has not been any monitoring of events to know the facts. Other similar venues do regulate their sound and time and we suggested following their lead. As a compromise Councilwoman Lori Boyer, who serves on the Ad Hoc committee, offered a bill which will force the City to monitor the events through April 30th, at each stage and each mixing board, and in Southshores, St. Nicholas and the neighborhood north of Everbank Stadium. This bill was drafted this morning, has no number as of this writing, and will be taken up as an emergency Tues night by the City Council if the President Bill Bishop adds it to the Agenda.

This would have us endure shows produced by private promoters through April 30, including the Boat Show, which seems to be relatively innocuous. After the facts are in there would be an attempt by the Ad Hoc Committee to set the dB level respecting the residential neighborhoods. (By the way... the national and internationl norm is 75dB over a 15 minute period, and max low frequency 70dB in 63Hz or 125 Hz octaves.)

As Jan has suggested a good showing of neighbors at the City Council meeting Tues night would be very powerful, because so far they perceive us as just a band of 2 or 3 ladies who are concerned.

After many hours of hearings, I have concluded, along with a lack of any real management in the Park, that the private ticketed events are so onerous and different than City events, because they are allowed to put up additional stages for productions. All City events are held on the one stage in Met Park, built exactly for these type of productions. Aditional stages each have sound equipment. I have repeatedly said Met Park is a Pavilion not an Amphitheater. And I wish to enjoy events there but in a fashion that respects our neighborhoods which were built in the late 1940's much before Met Park was a twinkle in Mayor Godbold's eye.

There is substanatially more which has been discussed by the Ad Hoc Committee but this is the immediate issue for next Tues.night's
City Council meeting. Daniel's bill has many negative unintended consequences, such as lifting the ban on open container laws and permanently lifting the sound ordinance in Met. Park and other venues. We need to defeat 2013-166 (Daniel's bill) and support Boyer's emergency bill. With the patients of Job, I believe we will prevail and make long term changes to what's produced in Met Park which will respect our neighborhoods.

I got a call from a friend on city council and was told they are trying to push a change in the noise ordinance and will have a new bill to vote on this next Tuesday. They think no one really cares if they change the noise ordinance.

I have purchased 50 t shirts that say St. Nicholas for sale of $10/each. When we all walk in with these shirts on, we will have their attention. Let’s work together like we did 10 years ago.

We need 100 people there. They can call me at ***-**** or email me at janmiller85@*******.

We can make a difference to keep our neighborhood quiet but it will take a little effort.

If you don't like noise and excitement move to a small generic town. Jacksonville is completely surrounded by them. We want a city here. You old farts have an almost infinite amount of small-town options out there. Why take away our only urban atmosphere in the entire area?

That is embarrassing, coming from someone who is supposed to be a lobbyist.

The only thing more embarrassing is when this same lobbyist called the promotors of Welcome to Rockville "weenies".

Now that the economic impact study is out showing Rockville's positive impact of over $10,000,000.00 I guess it must be pretty embarrassing to have been on the wrong side of this issue.

I guess that's why the hash tag #WeenieMyrick is going around.
