Minimum distance to a church doesn't make ANY sense. They wont be operating at nearly the same time of day, and patrons of both will go completely unaffected by the other. Any reason that this law is still on the books? I'm actually curious.

^If that is the case, they better have a person out there the entire time or I don't see that agreement lasting. I live on Post and the Chinese restaurant's parking lot is trashed on weekend mornings from people who park there for the bars. I don't think the lot Kickbacks built has that problem since they employ someone to sit out there and confirm parking.

The name apparently is Element/Myth Bar and Club. Planning department is recommending denial.

And yeah, their application for zoning exception does state that they will have off street parking at the church.

The exception and waivers are to reduce the off street parking from 43 to 0 and to waive the minimum distance from a church. RAP has passed out flyers in the surrounding neighborhood concerning this situation.

The new J-Bill going to Tallahassee will reduce off street parking requirements and amount of food needed to sell for a restaurant/bar to open.We're about to be invaded by a lot more bar/restaurants, if it passes. Good or bad, neighbors, JSO will all be busy for years to come. And then there are the lawyers.....

J Bill is still a protectionist measure...  It makes zero sense why a place with 100 seats and 1,800 Sq feet can sell liquor but a place with 99 seats and 1,700 sq feet cannot...  unless you have looked at the size of the places that can fit 100 people and 1,800 sq feet and determined there are just not that many of them.  and they still need to meet parking requirements.  which is even more stupid.


Like a place with 25 seats would fit in much better because they wouldn't need any additional parking, but you can't adaptability reuse these spaces...  so you need a bigger space which needs parking that doesn't exist.  Monopolists continue to exercise control.  Viola.

The bill would change the SRX (special restaurant exemption) requirements regulating a "bona fide" restaurant. These specifications are already in place for downtown Jacksonville and the 5 Points area. The reduction in restaurant size encourages adaptive reuse of smaller historic properties and would allow other small scale restaurants in the neighborhood to be able to do the same. It would only impact those restaurants meeting the following criteria:

• At least 1800 square feet of service space
• At least 100 seats
• Sell 51% or more in food (rather than alcohol)
• Hold a SRX license to serve beer and wine (regulated by the State)
• Kitchen open while alcohol is being served

Restaurants will still need to apply for a zoning exception for the sale of liquor and must meet any other local zoning requirements.

The current law requires 2500 square feet of service space, 150 or more permanently covered seats, 51% or more of sales in food, and the kitchen must be open when alcohol is being served.

This bill will be presented on September 24, 2015 to the Duval Delegation between 1 p.m. and 4 p.m. in City Council Chambers, and RAP will be sharing updates as they occur.

Where are you getting this misinformation?  The J-bill in no way alters the Riverside Avondale Zoning Overlay, including parking requirements by character area.  It also does not change the state's definition of a bona fide restaurant, therefore, it is not reducing the amount of food that must be sold to qualify as a bona fide restaurant with an SRX license.  A j-Bill only affects state law.  In this case, the proposed bill reduces the number of seats and square footage for service areas.

The new proposed J-bill is going to really stretch the limits of the citizens and what they are willing to tolerate. The Bar/Restaurants are going to be a lot easier to setup and parking is going to be more of an issue to a point of citizens really wondering what its leaders are "not" doing for the citizens.

I am not willing to say where this information is coming from, but its coming direct from the ground floor.

The applicants for this have withdrawn their application.  Evidently they figured they were headed for denial and have decided to look on Bay St for a place.

The church was being persuaded not to rent the parking to them.

It's not easy finding space for 100 seats and 1,800 Sq ft, and it's not that economical.  If you go to places in other cities (NY Chicago, LA SF), you see plenty of 25-60 seat places.  100 seats is a lot of seats.  and the area they are talking about doesn't lend itself to too many more than the already scoped out Casbah and Biscotti's.  This is just an end run around the interests that squelched the special legislation last session, it's not designed to actively encourage adaptive reuse of retail spaces, or spur restaurant entrepreneurship.  Which is exactly what you would expect from Jim Love and RAP.

So all the concern is unwarranted.
