Bill Summary: The bill amends Ordinance Code Chapter 35 – Regulatory Compliance Department to create a new Consumer Affairs Office to be responsible for enforcing and administering all laws and ordinances relating to consumer affairs, deceptive and unfair trade practices and charitable solicitations. The bill also amends Chapter 250 – Miscellaneous Businesses, Chapter 696 – Deceptive and Unfair Trade Practices, and Chapter 804 – Traffic Code to make reference to the new Office of Consumer Affairs in provisions regarding enforcement of various ordinances now being assumed by the office. The bill also makes several other scrivener's corrections of department and division names that were left unchanged after recent administrative reorganizations.

Background Information: The City appears to have had a Consumer Affairs office or division of some sort since the time of consolidation, which was shifted from department to department through numerous administrative reorganizations over the years. The reorganization approved by Ordinance 2011-732-E in December 2011 repealed the Consumer Affairs Division as it then existed in the Environmental and Compliance Department. This bill re-creates a Consumer Affairs Office in the Regulatory Compliance Department and makes reference to the Office in other Code chapters where Consumer Affairs is given responsibility for regulation and enforcement of ordinances regarding miscellaneous business regulations (downtown and sidewalk vendors, peddlers, transient merchants, ice cream trucks, etc.), deceptive and unfair trade practices (i.e. counterfeit goods, false or misleading advertising, etc.) and, permitting of charitable solicitations in public rights-of-way.
