Appealing the Approval of COA 13-430 - the demolition of 253 East 2nd Street

PSOS filed the required paperwork to appeal the COA in the case of 253 East 2nd Street.  You may remember that we have previously appealed the demolition COA of 129 East 2nd Street, without much success, but we feel it is extremely important that the city be accountable for its actions against historic properties.

The staff and the commissioners have now stated that they will not properly review any emergency demolition applications.  We believe it is against the law for them NOT to do so.

PSOS is requesting that the approval of this COA be invalidated and the issue sent to the proper enforcement authority.

Your post says the staff stated they will "not" review.  Did you mean will "now" review?  I am a bit confused but that may have to do with me having a raging headache.

Sheclown, my question is who is the enforcement authority? There does not appear to be anyone in the city that will take on MCCD, including the people she works for. Who do you go to that is over the city?

If it's Federal Funds ultimately you go to the Feds.

Check the link I gave you to earlier that spells out what the city is supposed to be doing in cases like this.  It may be time to take your concerns to members of the council and ask for an outside review.

The appeal hearing will not be at this month's HPC.  It is deferred until next meeting.
