ORDINANCE 2013-226
AN ORDINANCE repealing Part 2 (Entertainment District), Chapter 191 (Special Events and Entertainment District), Ordinance Code; amending section 368.105 (exceptions), Part 1 (General provisions), Chapter 368 (Noise Control), Ordinance code, to remove the exception for chapter 191, Part 2, Ordinance code; PROVIDING AN EFFECTIVE DATE.
   
   BE IT ORDAINED by the Council of the City of Jacksonville:
Section 1.      Repealing Part 2 (Entertainment District), Chapter 191 (Special Events and Entertainment District), Ordinance Code. 
Sections 191.201, 191.202 and 191.203, Ordinance Code, a copy of which is attached hereto as Exhibit 1 and comprising the entirety of Part 2 (Entertainment District), Chapter 191 (Special Events and Entertainment District), Ordinance Code, are hereby repealed and reserved in their entirety.
Section 2.     Amending Section 368.105 (Exceptions), Part 1 (General Provisions), Chapter 368 (Noise Control), Ordinance Code, to remove the exception for Chapter 191, Part 2, Ordinance Code.
Section 368.105 (Exceptions), Part 1 (General Provisions), Chapter 368 (Noise Control), Ordinance Code, is hereby amended to read as follows:
Chapter 368.   Noise Control
Part 1.   General Provisions

   Section 368.105. Exceptions.
This Chapter shall not apply to:

(g)   Fireworks and outdoor musical entertainment permitted pursuant to Chapter 191, Part 2, Ordinance Code.
(h)(g)   The unamplified human voice.
(i)(h)   Sound emitted from safety relief valves and rupture discs.
   Section 3.       Effective Date.    This ordinance shall become effective upon signature by the Mayor or upon becoming effective without the Mayor’s signature.

So how many entertainment district ordinances are out there now?  Does anyone have a handle on this?

I think there are three.  Redman's initial one, followed by Daniels and now the one above.  In the mix was the short term waiver voted on last week.  At some point in order to understand all the proposed legislation, posting of the original ordinance (the one rarely enforced) would be in order to compare the current changes to I believe.  I am guessing Legislative services could help identify that more quickly than an online search for the original.

What a tangled up mess.

Wasn't it mentioned in the meeting last week that some thought the original was supposed  to be revoked after the supper bowl but somehow wasn't?  Isn't this new ordinance just trying to do that?  And won't that make Daniels' ordinance mute as no entertainment district will be here to be expanded?
