Tacky or Just Bad Business?

What is your take on the following ad, with regard to a subject that will no doubt stir controversy:

Ridiculous ad.  The fact that the "actress" is suing is even more ridiculous.

Can't it be both tacky AND bad business?

I can appreciate the reason for the lawsuit, assuming she did not give them permission to use her likeness. Of course, I'm not a lawyer, so I basically have no idea what I'm talking about.

I agree...sounds like she didn't sign off on her likeness to be used in that ad. 

Also reminds me of the local radio channel 102.9 ads.  They think they are being funny.  They want to be Dave Chapelle or The Family Guy but don't realize that their offensiveness is neither funny nor intelligent.  Just reduces it down to offensive and obnoxious.
