I saw this human waited for the dog finished poo and continued to walk south along Laura st. I asked him to consider picking up his dog's poo. He refused. When I suggested him to consider if the situation is to be reversed, he further declined to pick up his poo.
I ask everyone please keep an eye out for this person and dog and persuade him to adapt to common courtesy of human society. I am NOT suggesting we all walk our dogs to his house for bowel movement or deposit animal feces in his yard or use any dramatic gesture as last resort.
All readers are welcomed to copy and post the content to other publishing outlet for the purpose of identifying the said human and poodle and discouraging such uncivilized behavior."
This is classless behavior, but a far sight better than what I thought when I read the title. I thought the human was the one making the deposit in your yard. So look on the bright side, at least that didn't happen. :)

the dog, cat or squirrel do not know better. The human is to blame. BTW, I think most cat owners do provide litter box for their cats. Most cats do cover their poop after the business.

You are right. What I meant was... the cat owners who just open their door and let the cat roam all night. Cats owners have the same obligation as dog owners to clean up after their animals.

What is the actual law in Duval county? I myself don't know, but I would guess the dog must be leashed and the owner must clean up. This is usually the case. For cats, there usually isn't a leash law if the cat is fixed, but poop cleanup is required.
If this is indeed illegal, I would have just called the police or appropriate city agency. In the absence of an HOA where the owner would be fined, turning to the appropriate city agency is all we have. My past experience in serving on an HOA has taught me that it's better to never confront an offender directly, but just use the mechanisms in place (by-laws, rules, fines) to deal with the behavior. It might seem impersonal but it avoids dangerous confrontations and treats everyone the same (i.e. no favoritism).

(b) For the purpose of this Section, "habitually" means at least two separate occurrences within a time period of no more than one month; except that barking habitually, or making other objectionable animal noises habitually, means making the sound persistently or continuously for at least 30 minutes occurring at least three separate times within a period of no more than eight hours.
(c) The animal control officer may cite the owner or any person having custody of such animal(s) for violation of this Section when either the citing animal control officer has witnessed the commission of such habitual nuisance or the animal control officer has received at least one sworn affidavit from each of at least two unrelated adult witnesses from different residences so that taken together, the affidavits attest to the committing of a nuisance pursuant to this Section.
(d) Each violation of this Section shall be punishable by a fine of $300. A subsequent violation of this Section within 30 days of a previous citation for violation of this Section shall subject the violator to double the fine, except that such fine shall not exceed the maximum fine allowable under the law.

Based on the municode then StephELF there is no problem. As long as you the property owner don't care it isn't a citable infraction. I would caution though to make sure you wear your shoes and keep any animals you have up-to-date on deworming as many poop parasites are contagious to humans as well as their pets. And they aren't all visible in the poop. Here is the full section of that code that BT referenced:
Sec. 462.301. General.
(a) Animals shall not be kept on property in a manner that causes any one or more of the following: creates unsanitary conditions; is a source of infestation by insects or rodents; creates physical conditions that endanger the health or safety of humans, that are detrimental to property values, or that tend to degrade the appearance of a neighborhood.
(b) Whenever an animal defecates upon any property not owned, leased, rented, or otherwise in the care, custody, or control of the animal's owner, the animal's owner shall immediately remove and properly dispose of feces. The only exception is by permission of the property owner.
(c) An owner shall remove and properly dispose of feces and other animal wastes on owner's property so as to avoid noxious and nauseous odors that are irritating, annoying or offensive to a person of normal sensibilities; or that are injurious to human, plant or animal life; or that reasonably interfere with the use and enjoyment of property.

The owner of a female dog or cat in heat shall, at all times, keep it securely confined on private property and inside a secure building or secure enclosure having a secure top and bottom attached to all sides so as to prevent conception, with the exception of controlled and intentional breeding. A female dog or cat found to be in violation of this Section is hereby declared to be a nuisance and may be impounded as provided in this Chapter.
I am by no means saying other homeowners don't have the right to be annoyed. Nor am I saying their rights have not been violated by the offending poo-er.
All I am saying is some people don't care, and I am one of those people. ;D

After a rough day at work, I needed a good laugh.
Two points. One, I have a dog and always pick up after him and yes, think it is quite rude others don't follow the same courtesy. It comes down to a matter of respect.
And two. I live in Springfield with an alley behind the house and I guess alley is synonymous for bathroom because I catch "man" doing his "thang" all the time. I love it when the headlights catch the glistening bum of a bum as I turn into the alley at night. Or they try to grab a quick pee behind the dumpster before hopping on the bus (no wonder we think buses are dirty!). Unfortunately Stephen, "it still is how it works in the neighborhood."
To those who posted, thanks for the 411 on the codes. If we take anything of value any from this thread that would be it. The one thing it seems to be lacking is any enforcement of people who don't clean up after their pets. Both 303 & 304 had fines, etc, but 301 was lacking.
