Title: Mellow Mushroom Live Oak Tree
Post by: Duvaltopia on November 03, 2013, 05:58:09 PM
I hear Mellow Mushroom wants to cut down the medium sized live oak shade tree on the corner of Ingleside and St. Johns Avenue because 'it will block their signage.' This important shade tree is along the public sidewalk. Now, I know the owner said he wanted to respect the neighborhood, so this can't possibly be true. Does anyone have any information?

Hmmm, I don't know if this is true or not but I do know this would not be an issue if they would have been allowed to do their original plan.  In the old plan, you would have ended up with public green space at that corner and outdoor seating.  At this point, they respected a portion of the neighborhood's wishes by demolishing the gas station and spending more money to build a structure right up on the sidewalk.

Not just did they spend more to accommodate the their neighbors they also agreed to make less on their investment by reducing seats. Clearly they are willing to be a good neighbor.

That said I like that oak it should stay.

Here's the city's tree protection code if you want to research it.

If they'd been allowed to have their original design (which was much better than the suburban box WLA made them build) this would have been a non-issue.

Wait, how is this a "suburban box?"

Have you looked at it compared to the original adaptive reuse that WLA killed?

It's not "suburban", but it's definitely not as good as the original plan.

Also, do we even know if this is true or not?

I look at it everyday and would have much preferred the original design.  But i dont think you can call a zero lot line building suburban, it matches the surrounding neighborhood...unless Avondale would be considered suburban.

The tree suffered a bit during the road construction, but it is alive and well and should be kept as part of the landscape. These oak trees are what define Avondale. If Valentino wants to keep things agreeable with his neighbors, he should be protecting this tree. I'm assuming he gets this and hope this rumor is not true. And no, I'm not a member of We Love Avondale.

Just looked at aerials and it appears that the tree in question is in the city ROW. Its typically much harder to remove a tree in city ROW than on private property, but I'm not familiar enough with COJ's tree code (linked earlier), nor do I have the time to research it. I do believe that Live Oaks are a protected species and have to be replaced at an inch for inch caliper basis though, and by another Live Oak.

Translation: If the city allows MM to remove it from the ROW, MM will likely have to mitigate that loss with a like for like replacement.

Even if it died it should be replaced.

Getting to be?  I think they have been since their very beginning.

The tree is not sick and does not need to be replaced. Some top branches died during road construction two years ago, but the tree is dark green, healthy and growing. This is a Mellow Mushroom red herring...being promoted by its MetroJax puppets. And surprise, surprise...today there is a sign out front asking for a city hearing for 'new signage.'

I had supported Mellow Mushroom. Now that they are cutting down Avondale's trees with a snake move, I'm out. Carmine's has much better pizza anyway.

I personally saw John Valentino painting red X's on several oak trees in Boone Park.  I can only assume he was doing it to mislead the tree trimmers into cutting down more of Avondale's trees.  Disgusting.

Pretty sure this will inspire Mellow to give up on pizza and go back to the sex toy/head shop concept they were originally proposing.  Tree cutting + new signage variance = big pole sign for the "Bongs N Dongs" flagship.  Count on it.

Confirmed, we're all puppets. Took this picture at the last MJ meetup.

This is just WLA trying to stir up more crap. A tree can look healthy, but be rotten to the core (believe me, I know, we just had to bring down a live oak and a water oak that both looked to be perfectly fine, but had 1 foot diameter black rotten channels running up the middle of the trunks for about 6 to 10 feet.

If the tree needs to be replaced, then it needs to be replaced. If MM is willing to replace a tree on city property (something it sounds like it isn't obligated to do) we should be thanking them.

I just heard from WLA the tree is being replaced with this one;

Looks like a perfectly healthy tree to me. It seems like a stupid move to cut it down. I think everybody is fully aware that the mellow mushroom is going in there. I can't imagine that a tee blocking a sign will detour a customer from stopping in. If that tree gets cut down I certainly won't support MM. They've already pissed so many people off as it is, why take it any further?

How about you go to the meeting before you decide that "Now that they are Avondale's trees with a snake move".  Hasn't MM proven that they want to be a good neighbor already? So at least go see if the rumors have any truth to them first.  Obviously this is falling on deaf ears you wouldn't have phrased it as " cutting down Avondale's trees" if you weren't trying to pull a very amateur spin job.

Seriously if there is a published meeting to see what the neighborhood wants how can you pretend they aren't trying to be good neighbors?

Much more reasonable opposition position to the tree being cut down.  It looks healthy to me as well I would certainly want the city to solicit an expert opinion before even considering replacing it.
