The student needs some serious help.  She used the f word.  That wasn't very nice.

Did an impartial jury make that decision or are we going to toss out the Sixth Amendment on this one?

Well, I am impartial, since I don't have kids and not near her age group...

If I was on a jury, I would most definately say it was the bus driver's fault. No matter what a child does, it is always the up to the Adult to make the wise decisions. I would have let her ass fall out of that emergency exit as I sped off if I was the bus driver! She would have definately been free to go... out the back door. So what if a child has a smart mouth and a bad attitude. Let them get off the bus, then write them up & let school administration take care of it. Don't put your hands on her and try to restrain her. Let her go, and notify the police, school, and her parent(s). It could have been that simple.

To quote a commenter on youtube

" Teenage Drama Queen + Irresponsible Bus Driver = Fat Ass Lawsuit ... don't you just love America? "

Why did the bus driver pull over and get out of her seat to ask the girl why she's on the bus? Obviously it's because the bus is going someplace she wants to be.

Plus, if she's not going to let the student off the bus, then why stop and talk about it? Just let the school know the next day and let them deal with it. Who cares who is on the bus, just DRIVE!

The bus driver created the situation 100%.

#1)  The bus driver would have gotten in trouble if the phone would have exploded in the girls ear since you're not allowed to use the cell phone during school hours.  The driver would have gotten fired.

#2)  The bus driver would have gotten in trouble if she let the girl off the bus.  The driver would have gotten fired for letting the girl off the bus.

#3)  Given the bus driver was screwed either way.  She's fired.

#4)  You have the right to protect yourself.  The girl could have had a gun, or a knife.

#5)  Given all the above you could never convict the bus driver for protecting herself and others.

#6)  If the bitch wont quit, you must acquit.

Mark, my office mate offered this.  He should have been able to look up in the mirror and say, hey, get off the phone.  If the girl didn't comply, he would have driven back to school and let the parents come pick them up, or taken them to the police station.  Mark was a subsititute teacher, and said, you have to take the class pedilogical thinking.  That kids aren't wired right.  He wouldn't have convicted the driver.  That most of the kids should have gone to juvee.

At the beginning of the video everyone looked pretty calm. The bus driver instigated the situation by stopping the bus and talking with that bratty girl.

What do you think is going to happen when you confront a bus full of juvenile delinquents? If she just drove her route she wouldn't have any problems.

Oh, and the fact that the bus drivers daughter was on the bus and started attacking the other girl was very Jerry Springer-like. Priceless.

I don't see where the bus driver really did anything wrong. Who know's how many times they have had problems with that girl, heck maybe she isn't supposed to be on the bus. Then the bus driver was trying to move her back to her seat, but the girl bucked. What do you expect, we are in the Britney Spears and 50 cent generation.

All she was protecting them from was a loud mouth. If she was going to lose her job, why touch the girl? Now you have no job ...and an assault trial, possibly. I think she just got too caught up in the moment. I don't know what she had to prove? Just let the girl go. She had no business trying to restrict the girl from leaving the bus with PHYSICAL force. That's just not their job. If that was the case, tell me how the school board would expect those little old ladies to stop a 280lb. football player from getting off the bus? With a rifle?
